This page documents how WTUC (West Texas Urgent Care, PLLC) ("the Company") collects consent from clinical providers to receive operational SMS text messages, as required for our internal Provider Operational Messaging program.

Program Overview

The Company operates an internal SMS program used by company leadership (CEO and COO) to send one-way operational text messages to credentialed clinical providers — Medical Doctors (MDs), Doctors of Osteopathic Medicine (DOs), Nurse Practitioners (NPs), Physician Assistants (PAs), and Certified Registered Nurse Anesthetists (CRNAs) — who are employed or contracted across the Company's urgent care, freestanding emergency room, and primary care locations in Texas.

Message content is strictly limited to internal operational matters, including:

No patient information, no Protected Health Information (PHI), and no marketing or promotional content is sent through this program.

How Consent Is Collected

The Company collects express written consent from each provider before enrolling them in the Provider Operational Messaging program. Consent may be provided through either of the following methods:

Primary method: online consent form

Providers may complete and submit the Company's online consent form located at https://www.myurgentcaretx.com/provider-sms-consent-form. The form collects the provider's full legal name, credential, primary location, mobile telephone number, and email address. The provider must then read the consent statement reproduced verbatim below and affirmatively check a required consent checkbox before the form can be submitted.

Submissions through the online form constitute valid electronic written consent under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and the Texas Uniform Electronic Transactions Act (UETA, Tex. Bus. & Com. Code Ch. 322). Submission timestamp and other metadata are recorded for auditability.

Secondary method: paper acknowledgment

Providers may alternatively complete a signed paper acknowledgment form during onboarding or upon request. The paper form contains the same consent language as the online form and requires the provider to provide their mobile telephone number, sign, and date the acknowledgment.

For providers onboarded prior to the implementation of this program, the Company collected a separate written acknowledgment — either online or on paper — before sending any SMS to that provider's mobile number.

Recordkeeping

No provider is enrolled in the program without an affirmative written consent on file. All consent records — whether submitted electronically or on paper — are retained in each provider's HR or contractor file and are auditable on request.

Consent Language

The following consent language appears on both the online consent form and the paper acknowledgment form. Providers must affirmatively agree to this language before being enrolled in the program.

Provider SMS Consent

I consent to receive operational SMS text message communications from WTUC (West Texas Urgent Care, PLLC) and its affiliated brands at the mobile number I provide. I understand these messages will be sent by company leadership and will contain only internal operational information, including schedule changes, coverage requests, policy updates, and operational notices. I understand that no patient information or Protected Health Information will be sent via SMS through this program.

I understand that message and data rates may apply based on my mobile carrier plan, and that message frequency varies based on operational need. I understand I may reply HELP at any time for assistance, and may reply STOP at any time to opt out of further messages from this program. Consent to receive these messages is not a condition of employment or engagement.

I confirm that the mobile number I provide is mine or that I am otherwise authorized to provide consent for that number, and that I am at least 18 years of age.

How to Opt Out

A provider may opt out of the Provider Operational Messaging program at any time by:

Upon opt-out, the provider's mobile number is removed from the active recipient list and no further messages are sent from the program.

Privacy of Mobile Information

Mobile phone numbers and any data collected as part of the SMS opt-in process are used only to operate this messaging program. The Company does not sell or share provider mobile information with third parties or affiliates for their marketing or promotional purposes. Mobile information is shared only with the Company's SMS platform service provider for the sole purpose of message delivery, under contractual restrictions.
