1. Agreement to These Terms

These Terms of Service ("Terms") are a binding agreement between you and West Texas Urgent Care, PLLC, doing business as My Urgent Care TX, My ER 24/7, My Primary Care, My Telemed, ReGen, and My Health Plan (collectively, "we," "us," "our," or the "Company").

These Terms govern your access to and use of our websites, including myurgentcaretx.com, mytelemedtx.com, myprimarycaretx.com, and our other affiliated brand websites (collectively, the "Sites"), and any related online services we provide.

By using the Sites, you agree to these Terms. If you do not agree, do not use the Sites.

2. Not Medical Advice

The Sites provide general health and wellness information, scheduling tools, and information about our services. The content on the Sites is not medical advice and is not a substitute for diagnosis, treatment, or professional judgment from a qualified healthcare provider. Reliance on any information on the Sites is at your own risk.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Sites, online forms, or text messages to communicate medical emergencies.

A provider-patient relationship is established only when you are evaluated and treated by one of our clinicians, either in person at one of our locations or through a properly initiated telemedicine encounter.

Some Sites allow you to request appointments, complete intake forms, or schedule telemedicine visits, including through third-party platforms such as Solv Health. By using these tools you agree that:

You must be at least 18 years old, or the age of majority in your state, to use the Sites without the involvement of a parent or legal guardian. If you create an account or membership with us (such as My Health Plan or ReGen), you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

All content on the Sites — including text, graphics, logos, images, video, software, and the overall design — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print pages from the Sites for your personal, non-commercial use. You may not otherwise copy, reproduce, distribute, modify, or create derivative works from the Sites without our prior written consent.

The names "My Urgent Care TX," "My ER 24/7," "My Primary Care," "My Telemed," "ReGen," "My Health Plan," and our related logos are trademarks of the Company.

8. User-Submitted Content

If you submit reviews, testimonials, photos, or other content to us or to platforms we operate, you grant us a non-exclusive, worldwide, royalty-free, perpetual, transferable, sublicensable license to use, reproduce, display, distribute, and create derivative works of that content in connection with our business. You represent that you own or have the necessary rights to submit the content and that the content does not violate any third party's rights or any law.

You are solely responsible for the content you submit. We are not obligated to monitor user-submitted content but may remove any content at any time in our discretion.

9. Third-Party Sites and Services

The Sites may contain links to, or integrate with, third-party websites, applications, and services (such as Solv Health, payment processors, and social media platforms). We are not responsible for the content, terms, or practices of those third parties. Your use of third-party sites and services is at your own risk and subject to their terms.

10. Disclaimers

THE SITES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SITES WILL BE UNINTERRUPTED OR ERROR-FREE.

WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY HEALTH OR MEDICAL INFORMATION ON THE SITES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITES, REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITES WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

These limitations do not apply to liability that cannot be limited under applicable law, including liability for personal injury caused by professional negligence in the course of providing clinical care.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their officers, directors, employees, providers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Sites, your violation of these Terms, or your violation of any law or third-party right.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Sites will be brought exclusively in the state or federal courts located in Taylor County, Texas, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Continued use of the Sites after changes are posted constitutes your acceptance of the updated Terms.

15. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and SMS Messaging Terms, constitute the entire agreement between you and us regarding your use of the Sites.
